Privacy Policy

What we collect, and what we do with it.

Hola handles phone calls and messages, which means it handles what people say. This explains how that information is used, kept, and deleted.

Who this covers

This policy applies to the Hola service operated by Digital Swap LLC, 493 Farnham Avenue, Lodi, NJ 07644 (“we,” “us”). It covers two groups of people: the businesses that subscribe to Hola, and the callers and customers who reach those businesses through a phone call, text message, web chat, or social message that Hola handles.

For calls and messages with a business’s customers, the business is the owner of that information and we process it on their behalf, under their instructions.

Information we collect

From businesses

  • Account details: name, business name, email, phone number, mailing address.
  • Billing information, processed by our payment provider. We do not store full card numbers.
  • Business knowledge you give Hola: hours, prices, menus, services, booking rules, staff names, and routing preferences.
  • Usage data: logins, dashboard activity, settings changes.

From callers and customers

  • Phone number and caller ID name where the carrier provides it.
  • Audio recordings of calls Hola answers or places, and the transcripts and summaries generated from them.
  • Message content from SMS, web chat, WhatsApp, and Instagram or Facebook DMs, along with the sender’s handle or number.
  • Details you provide during the conversation: your name, the appointment you booked, the order you placed, a delivery address, a callback time.
  • Date, time, duration, and outcome of the interaction.

From the website

We collect basic, aggregated analytics — pages viewed, referring site, approximate region, device type — using cookies and similar technology. We do not use advertising cookies or sell website data.

Call recording and consent

Calls handled by Hola may be recorded. Businesses using Hola are responsible for providing any notice required where they and their callers are located, including in states that require all parties to consent to recording. Hola provides a recording notice and will disclose that it is an automated assistant when asked. A caller who does not want to be recorded can say so, and Hola will take a message or transfer them to a person instead.

How we use information

  • To answer calls and messages, and to do what was asked — book, order, quote, route, take a message.
  • To produce recordings, transcripts, summaries, and dashboard reporting for the business.
  • To send transactional messages such as confirmations and reminders, and opt-in broadcasts where consent was given.
  • To bill for the service and support the account.
  • To keep the service secure, prevent abuse and fraud, and meet legal obligations.
  • To improve accuracy and reliability, using de-identified or aggregated data.

We do not sell personal information, and we do not share mobile opt-in consent or phone numbers with third parties for their own marketing. We do not use customer call content to train general-purpose AI models for other companies.

Who we share it with

  • The business you called. Recordings, transcripts, and summaries appear in that business’s dashboard.
  • Telecom and messaging carriers, to place, receive, and deliver calls and texts.
  • Speech and language processing providers, to convert audio to text and generate replies, under contracts limiting their use of the data to providing that service.
  • Infrastructure and payment providers, for hosting, storage, monitoring, and billing.
  • Legal and safety, when required by law, subpoena, or to protect someone’s safety or our rights.
  • A successor, if the business is sold or merged; we would tell you first.

How long we keep it

  • Recordings, transcripts, and message threads: kept while the account is active, and deleted 30 days after the account is closed unless the business exports or deletes them sooner.
  • Business account and billing records: kept as long as required for tax and accounting purposes.
  • Website analytics: retained in aggregate for up to 24 months.

Businesses can set a shorter retention period for recordings in the dashboard, or delete an individual conversation at any time.

Security

Data is encrypted in transit and at rest. Access to recordings and transcripts is limited to the account’s authorized users and to the small number of our staff who need it to run and support the service. We log that access. No system is perfect; if a breach affects your information, we will notify you as required by law.

Your choices and rights

  • Access and copies. Businesses can export their conversations from the dashboard. Callers can ask us or the business for a copy of what was collected about them.
  • Correction and deletion. Ask us at admin@digitalswap.co. If the request concerns a call with a specific business, we may direct it to that business, who controls the record.
  • Messages. Reply STOP to any text to stop messages. See the Messaging Program page.
  • State privacy rights. Residents of California and other states with comprehensive privacy laws may request access, deletion, correction, and portability, and may appeal a denial. We do not discriminate against anyone for exercising these rights.

We respond to verified requests within 45 days.

Children

Hola is for businesses. We do not knowingly collect information from anyone under 13. If a child’s information reaches us through a call, the business or a parent can ask us to delete it.

Changes

If we change this policy in a way that matters, we will post the new version here with a new effective date and email account owners at least 10 days before it takes effect.
